Martin Andrew Elton is selling stolen property, and attempting to manufacture an unauthorised, unlicensed design through Powtek Ltd.

Martin Elton is the sole director and full shareholder in Powtek Limited. Mr Elton is also director of Loadtek Instruments Ltd, the company he has defrauded. At the time of incorporation of Powtek Ltd, Loadtek Instruments Ltd was manufacturing and selling a product identical to the one Mr Elton began selling.

Mr Elton's blatantly illegal and dishonest actions against Loadtek and myself include fraud, forgery, theft, lying and plagiarism. Mr Elton must be regarded with EXTREME CAUTION. UNDER NO CIRCUMSTANCES purchase product from Powtek / Mr Elton or entertain any thoughts of partnering with him or purchasing shares in the business until the situation can be resolved.

The list of Mr Elton's inappropriate behaviour includes:

• falsifying official company documentation and using this to support his illegal actions
• unlawfully taking the majority of Loadtek's plant and stock, refusing to return any of it, then selling it through Powtek Ltd.
• setting up Powtek Ltd in direct competition with Loadtek Instruments Ltd while director of both
• blatantly copying product documentation, including my personal work
• blatant plagiarism of the entire product design and manufacturing details
• misrepresenting the situation to his customers, distributors and suppliers
• breaching signed agreements
• lying verbally, in written form, and in signed written form
• attempting to silence me with threats of defamation action
• refusing to meet to discuss the situation or correspond with me

This has been ongoing since August 1999. A claim of NZ$100000 remains outstanding against Mr Elton for intellectual property arising from work that has not been paid for.

Any claims by Mr Elton that he owns the stock, or has legal rights to the stock and product design, or that I agreed he could use it out of Loadtek are UNTRUE. Mr Elton is a very persuasive, very plausible salesman. Mr Elton cannot change the facts, logically all he can hope to do is distort them and/or hide them from wider scrutiny. Be ready for smokescreens - I will be obsessed, crazy, acting out a personal vendetta, or acting with some unfathomable desire to kill the business. He may produce falsified documents or inaccurate legal advice in an effort to sell his story. One of us is obviously lying - please treat both parties with suspicion if you are unsure.

Clearly, I would not say any of this if I was unsure of my facts or did not have plenty of proof, and was not prepared to defend it in court.

Why I have put up this site?
My first priority is to warn potential customers, suppliers and business partners of Mr Elton's past actions against Loadtek Instruments Ltd and myself. This action is not entirely selfless. The product and business is largely my investment, it is up to me to minimise degradation of its value.

My second priority is to protect my reputation, as Mr Elton has misrepresented facts to other parties and continues to abuse my past work.

My third priority is to provide some incentive for Mr Elton to "come clean" and tidy up the loose ends he has created - and hopefully begin to act legally. In effect I am challenging Mr Elton to deal with what I am saying here in court and thus prove himself wrong.

I am also acting in the interests of basic honesty and truth. This is just core to my nature.

 If resolution can be achieved
Although Mr Elton seriously abused the past two attempts at negotiation and I have to be extremely wary of this happening again, I still hope an agreement can be reached.

If so, then Mr Elton may eventually obtain control of this site as part of the deal. In such a case, I will attempt to place an update clearly on this site highlighting the nature of any resolutions obtained for a period of thirty days before handing it on to any other party.
